No radical changes in amendment to Polish Gaming Act

The Polish Ministry of Finance has published another version of its amendment to the Act on games and mutual wagering, dated 5 August 2008.

The newest project has not introduced any revolutionary changes to previous project. However, it will create some confusion, as ir appears that the legislator in the article 4 of the act decided to add a new paragraph, in which it says that it is forbidden to use results of numerical games, money lotteries, video lotteries and telebingo game to organise and run mutual wagering, without the agreement of organiser and person who runs them.

"Honestly, I have no idea what bookmakers need results of lotto drawing or  bingo for. Maybe one can make a bet at a bookmaker, if in Multilotto drawing there is more even than uneven numbers, but I don't think that it would be super popular bet,"said an industry source.

There is no change in the ruling on placing gaming machines no less than 100 metres from a church. The deadline for introducing the new law has been extended to 31 December 2015, except for the AWP and mutual wagering sectors which will be taxed at the new levels by 1 March next year.

It is interesting that the government has changed the way it plans to collect its fees. Up until now it has been permanent amount, announced from time to time by the decree, now it is supposed to be relevant percentage of a so-called base amount. The base amount will be increased every year to the amount determined for the second quarter of previous year in an announcement of the President of the Central Statistical Office. For example, permission to operate an AWP is to cost 1,821% of the base amount plus 9% of the base amount for each point.

The only piece of good news to come from the amendment is that organisers of mutual wagering on horse races are released from the stake of 5% from the tax on games. They will  nowpay only 2%.
