The High Court of Justice in Madrid has rejected the Appeal made by the Madrid regional government, and by so doing confirms the ruling made by the Administrative Law Court No. 3 in favour of Recreativos Franco, by which the competence of its Auxiliary Metrology Verification Laboratory is recognized, and with it the legal certification of the counters which are built into its amusement machines.
This resolution signals an end to several years of legal conflicts on this matter. Also, an Order from the Ministry of Industry has been published that regulates the State Metrological Control of counters incorporated into amusement machines and games of chance machines (B and C). It has included the pleas made at the time by the Facomare association. The two most important aspects refer to the acceptance of the declaration of conformity based on the internal manufacturing controls plus the tests carried out on the product by an official body chosen by the manufacturer, and secondly that the periodic inspection that takes place on the machines should in future take place every 4 years instead of the present 2 years, which means that machines on the point of being renewed avoid having to be inspected again.
