The National Automatic Merchandising Association (NAMA) is urging operators to lobby their Congressional representative against the so-called "employee free choice" or "card check" legislation. It eliminates the secret ballot in union elections and could negatively impact small businesses.
NAMA opposes three former provisions that again appear- the elimination of a secret ballot to favor public declarations, which may promote coercion; government arbitration in several circumstances, impeding the employer's control over company operations; and increased penalties against employers for National Labor Relations Act violations, but failing to add new sanctions on unions or labor organizers.
Also, questions about the card's duration, forgery protections and whether employees can decertify a union by using the same process are under NAMA scrutiny. Association leadership states that vending operators would have to campaign year-round to counteract their unawareness of union activity.
