Much more than smoke

The implementation of the present anti-smoking law in Spain, approved in 2005, has been very irregular. The Madrid autonomous government, without going any further, approved in November 2006 a much more permissive decree than that prescribed by the law which, among other things, allows smoking in the bars at the workplace and eliminates the necessity to physically separate the smoking areas in premises of more than 100 square meters.

The then Health Minister in 2006, Elena Salgado, maintained that the decree was a “flagrant violation“ of the state regulation. In addition to the Madrid decree, Salgado also turned to the autonomous governments of the Valencian region, of La Rioja and of Castilla y Léon. At the present time Elena Salgado is the Minister of Economy, and the new Health Minister, Trinidad Jiménez has launched a new offensive against the smokers.

Already affected by the economic crisis, the total prohibition on smoking in enclosed premises announced by the Minister of Health may be the final straw for a sector that employs almost one million people. But what most infuriates the sector is the “joke” of having altered their premises on account of the present law, which demands a separate area for smokers. For this reason, as a result of the meeting that the employers’ associations belonging to the sector held at the CEOE (Confederación Española de Organizaciones Empresariales - Spanish Confederation of Employer Organisations) representatives of the businesses affected are considering asking the Government for damages and compensation.

Present at the meeting were employers from bars, discos, bingo halls, amusement arcades, casinos and hotels. The CEJ (Confederación Española de Empresarios del Juego del Bingo - Spanish Confederation of Bingo Employers) reckons the average cost of the alterations is 60,000 euros, in addition to losses of 900 million in income in the first year of the future prohibition. The CEJ represents 370 of the 420 Spanish bingo halls.
