New year, new modifications

The Spanish gaming market has always been a legal maze, suitable only for specialists or for those who, possessed with an infinite patience, are able to digest the interminable legislative changes that are forever taking place in the different autonomous regions. The professionals and businessmen who operate within the Spanish market have to make an enormous effort to keep themselves up to date.

Bingo, by virtue of the circumstances in which it has to compete, is one of the sectors where the changes are the most frequent. The latest modifications have been published by the Autonomous Governments of the Basque Country and La Rioja. The former has introduced its third modification within the space of four years. A text that specifies new percentages on bingo prizes and empowers the Minister of the Interior to directly adapt the gaming regulations to the different types of gaming.

For its part the Government of La Rioja approved a new Regulation in October 2009 and scarcely three months later it approved Law 6/2009 on Administrative and Fiscal Measures for the year 2010, whereby it is modifying the tax basis for the tax imposed on the game of bingo while at the same time incorporating a reduced type of taxation for those qualifying companies that do not reduce the number of employees during the 2010 tax year. Without wishing to judge the need for changes on a case by case basis, it is remarkable that they are always made “taking into account the changes that the market is able to sustain and the concerns expressed by the owners of the bingo halls”. In other words, the fact that the regulations do not bring the desired stability is not due to a lack of foresight or planning, but to the changes to which the regulated sector is subject.
