Two of the largest machine suppliers in Poland have been embroiled in a copyright battle since 2003. Britain’s JPM International has been involved in legal action against Nowopol of Poland and its Ukrainian Distributor Nowoslot in order to support its partners in Eastern Europe, Synot and its authorised subsidiary companies.
“This action has been taken to assert an infringement of JPM’s copyright and trademarks by the Nowopol companies in both hardware and software related to JPM copyrighted and patented products,” said a JPM company statement back in 2005.
“JPM International distributes exclusively through its legitimate partner Synot and Synot’s Ukrainian subsidiary Royale. JPM and Synot are undertaking a co-ordinated approach to these actions and see it as important that clients understand that the only JPM-branded materials that are authorised or endorsed by the legitimate copyright and trademark owners are those supplied from Synot. Infringements of any of JPM’s intellectual property rights will be treated in a similar manner.”
However, five long years later, Nowopol has emerged from the scuffle victorious, if somewhat battle scarred. It has been reported in the Polish National Press that JPM International Ltd had lost its court case.
“Nowopol was wrongly accused by JPM of changing EPROM data which would enable them to make copies of JPM’s machines and introducing them into the market between Dec 2001 until July 2003. JPM was asking for compensation of 1 600 000 PLN which is the equivalent of Ł351, 000,” said a Nowopol statement.
Nowopol Chairman Tomasz Wozny added: “Whilst we were always confident in defending ourselves in this case, it has caused irreparable damage to our business, our business reputation and also resulted in us losing several key contracts which ran into many millions of Euros.
“Following legal advice taken from our Government, lawyers in Poland and the UK, we will be seeking considerable compensation from JPM along side with Synot its exclusive dealer for Poland in due course. The position this unfounded action has left our business in is unacceptable.”
