Georgia operators triumphed when the Georgia Supreme Court overturned a lower appeals court’s decision in October, favouring adult redemption video games. The ruling declares these games legal, despite players’ ability to accumulate points or credits over several plays without paying for a new play.
The court also reaffirmed the games’ legality as amusement devices, reasoning that players must apply “some skill” to impact the outcome. A negative ruling would have eliminated the legal foundation for Georgia’s thriving redemption video game market.
State prosecutors argued these video games had characteristics of slot machines. They charged the games also allowed accumulation of points or credits over several plays.
But the court dismissed those charges because of a new law on 1 July, which clarified the legislature’s intent. A player receives a score, which signals the completion of the game or replay, and permits the player to win free replays, merchandise, points, tokens, vouchers, tickets or other evidence of winnings.
Georgia state law permits adult redemption video games with rewards of non-cash merchandise, prizes, toys, gift certificates or novelties.
