Computers set up in public venues specifically to access online gambling sites could legally be treated as unlicensed gaming machines, according to the UK’s Gambling Commission.
“A computer is not a gaming machine merely because there is a possibility of accessing a gambling Website via the Internet,” the Commission has ruled.
But it added: “A computer will, however, be considered to be a gaming machine if it is knowingly adapted or is presented to facilitate or draw attention to the possibility of it being used for gambling.”
Possible indicators of a computer being “knowingly adapted” are said to include icons for gambling Websites on the desktop, or such Websites being listed on an Internet browser’s favourites menu.
Also sounding warning bells would be screensavers or wallpapers referring to gambling Websites, downloaded gambling software, or any kind of promotiona encouraging the use of the computer for gambling – including staff simply mentioning the possibility to customers.
